Article 1: Protection of personal data

1.1

The purpose of this Privacy Policy is to inform the Customer in a complete and transparent manner about the use of their personal data by GOBOX, which intends to respect the privacy of each Customer.

1.2

The Site is secured by SSL encryption.

1.3

However, the Customer is aware that the Internet is not a completely secure medium, and that consequently, GOBOX cannot guarantee total respect for the Customer’s privacy and the personal data transmitted.

1.4

GOBOX undertakes to ensure that the collection and use of the Customer’s personal data carried out by it on the Site is carried out in accordance with the European and Belgian regulations in force, and in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (‘RGPD’), as well as the Act of 8 December 1992 on the protection of privacy with regard to the processing of personal data, as amended. These regulations can be consulted in full on the website of the Data Protection Authority at the following address: https://www.autoriteprotectiondonnees.be.

GOBOX SRL is responsible for processing this personal data and can be contacted at the following address: hello@gobox.be / +32 471 78 03 21.  Customer data is stored on the Bsport platform.

1.6

Only the personal data which the Customer communicates of his own free will when he fills in the contact form present on the Site with a view to his Registration on the Site are collected, recorded and stored in digital form by GOBOX: these are his surname, his first name, his date of birth, his mobile phone number and his e-mail address (hereinafter ‘the Personal Data’). This Registration is mandatory to book sessions with GOBOX.

The processing of the Personal Data collected at the time of the Registration is necessary for the execution of the contract between GOBOX and the Customer, namely the treatment of the reservation of session carried out, the invoicing, the information with the Customer concerning his reservation, the management of possible problems, etc. (art. 6.1.b. RGDP), and those are preserved until the expiry of the period of prescription applicable in contractual matter. None of this information is intended to be transmitted to unauthorised third parties, nor is it used for commercial purposes, except where necessary for the sending by GOBOX of information relating to the Site and its Services if the Customer has expressed the wish to receive information from GOBOX via the ad hoc form (collection of the Customer’s address).

1.8

The processing of Personal Data in the context of Registration via the form present on the Site with a view to receiving the Newsletter is based on the consent of the user of the Site (art. 6.1.a. RGDP), who may withdraw, at any time, his consent to the processing of his personal data by GOBOX without, however, this being able to affect the processing carried out prior to this withdrawal.

1.9

The Customer is informed that his personal data may be stored or transferred outside the EU. However, this transfer will only be made to a country recognised by the European Commission as offering an adequate level of protection.

Article 2: Image rights

2.1.

By his adhesion, except preliminary and express mention from his side, the Customer accepts the fact that it can be photographed or to be visible on a film carried out by GOBOX or one of its partners.

2.2.

By subscribing, the Customer :

1. Accepts that GOBOX decides, or not, to use and/or modify this appearance;

2. Accepts the commercial use by GOBOX of his name, image, likeness, voice from this appearance;

Expressly waives any right whatsoever related to the use or commercial exploitation of its appearance as defined above.

Article 3: Photography and films

The Customer may take any photograph or make any film of its participation in an event arising from the performance of the Contract provided that the use made of it is and remains strictly private.

In this case, it is forbidden to show another customer, a member of GOBOX staff or one of its third party partners.

Article 4 : Media

The Customer shall not set up or participate in any media coverage that has not been organized by GOBOX, without the latter’s prior written consent.

In the case where GOBOX organizes a media coverage within the framework of the execution of the Contract, the customer commits himself cooperating fully with the good conduct of this one.

Article 5: Intuitu personae nature of contractual relations

The Contract is concluded intuitu personae, so that the rights and obligations of the Customer cannot be assigned, in whole or in part, delegated or transferred to a third party, by any means whatsoever, without the prior written consent of GOBOX.

Article 6: Confidentiality

6.1.

The Customer and GOBOX will respect the confidentiality of their relations and will abstain from revealing any information collected within the framework of the execution of the Contract, including details of any event occurring within the framework of the Workout sessions service (such as an accident), except express agreement included in the Contract or in a separate writing.

6.2.

The Customer and GOBOX will take care themselves to protect the confidentiality of their own information.

This commitment is valid for GOBOX, the Customer as well as for their parent companies, sisters or subsidiaries, their own customers, their employees, as well as for all third parties for which they would be responsible.

Article 7: Nullity and severability

If one of the clauses of these general terms and conditions should be declared null and void, the parties undertake to negotiate a new clause in accordance with the law and the structure of the contract.

The annulment of a clause will have no influence on the other clauses, which will remain in force.

Article 8: Interpretation

These general terms and conditions have been translated into both English and Dutch.

In the event of any dispute, the French version shall take precedence over the other two.

Article 9: Waiver

9.1.

Any waiver of the Contract must be in writing.

9.2.

Any waiver of any of the clauses contained in the Contract may only be invoked by one of the parties on production of an explicit written document signed by the other party.

Article 10: Applicable law and jurisdiction

10.1.

The Contract shall be governed by and interpreted in accordance with Belgian law.

10.2.

Any dispute between the parties shall fall within the exclusive jurisdiction of the French-speaking courts of the judicial district of Brussels.

APPENDIX N°I: INTERNAL REGULATIONS

Article 1

Access to the GOBOX centre and its facilities is strictly reserved for Customers within the meaning of the GOBOX general terms and conditions.

In order to ensure that these rules are respected, GOBOX may require the Customer to show an identity document before arriving at the centre.

A Customer user cannot be accompanied to a session by a non-customer, who will have to wait for him at the entrance of the centre provided however that this person is of age or over 16 and accompanying a legal representative.

Article 2

Access to the sessions is strictly reserved for people who have registered for one of the day’s sessions via the gobox.be or GOBOX app or Bsport app platform.

As the sessions start at a strict time, Customers registered for a session must arrive ten (10) minutes before the time indicated, failing which they will be refused access (without reimbursement of the access fee).

The use of mobile phones is strictly prohibited during sessions.

The Customer undertakes to return to GOBOX, at the end of the session, any equipment loaned by GOBOX.

Article 3

For reasons of the collective safety of the Customer-users, and in order not to disrupt the sporting activities, personal belongings are not accepted at the Sessions.

Lockers that can be locked with keys are provided in each centre.

Lockers are neither supervised nor personally assigned and must be fully vacated after training. For reasons of hygiene and security, GOBOX reserves the right to open any lockers that have not been released on a daily basis.

Article 4

The Customer user undertakes to wear specific indoor sports clothing and footwear, exclusive of any other use.

The use of boxing bands is compulsory throughout the session (available for purchase at the GOBOX centre).

The Customer undertakes to return the towels and boxing gloves borrowed at the end of each session.

Hoods and hats are not permitted during sessions. Caps and headbands are permitted during sessions, provided that they do not present a safety risk for the Customer.

For reasons of hygiene, the User Customer must bring his/her own personal ‘inner handwraps’, ‘non-slip socks’ or those sold by GOBOX for each session.

The User Customer undertakes to comply with hygiene instructions and in particular to use the bins provided.

Article 5

The Customer-user undertakes only to practice a sports activities within the centre and to respect the activity offered in the various practice areas.

The Customer user undertakes not to damage the GOBOX facilities or equipment.

They must, among other things, put away and disinfect the equipment they have moved during the sporting activity.

Article 6

The Customer user may train alone and use all the equipment available, but is not authorised to give lessons or sports advice in the centre.

It is strictly forbidden to sell or offer any kind of service or product in the centre.
